Good News for H-1B Max-Out Individuals – PERM Labor Processing Times Improve

November 5, 2010

Good news for H-1B Max-Out individuals – The U.S. Dept. of Labor’s PERM labor certification application processing times have been significantly improving for the past few months. Currently, the Dept. of Labor is taking only about 60-90 days to process the PERM labor applications. This is helpful for individuals that are running out of their six years of H-1B stay and are planning to leave the U.S.  If they have a labor certification application in process already or is going to be initiated during the sixth year of H-1B, they are still able to get the labor certified, have the Form I-140 filed under premium processing (15-day turnaround time) and once the I-140 is approved, apply for H-1B extension seeking three (3) full years. Because these steps are time sensitive, it is imperative to plan well ahead and where possible, seek legal advice from an attorney, who can help strategize the case to undertake the above tasks in a timely fashion.
